小徐是首次置业者，听到有银行最近公开拍卖一些二手房，价格比市场价低，便心动了，但他又害怕房屋存在问题。近日多个读者向记者咨询银行拍卖房屋的问题，记者采访东莞房产中介后发现，这些房源地雷”甚多，业内人士提醒购房者必须小心对待。

拍卖房多有债务纠纷

世安居不动产总经理夏玉飞告诉记者，拍卖房多属于有债务纠纷的房子,所以价格才便宜。而且重要的是,经法院拍卖的房子即使手续齐全，并不表明一定能办到房产证,因为办房产证涉及到发展商、物业管理公司、银行等多方，而这些单位都可能是抵押债权人，都会影响房产证的办理。夏玉飞表示，拍卖物业因为属于非正常交易过户,所以不能办理贷款，购买者应该充分考虑其风险。

合富置业市场部经理林晶表示，这类房源不少是因为购房贷款者还款中途失去还款能力，而银行作为债权人有权将房屋拍卖并追回既得利益，所以此类房屋很多是没有办理房产证的。

林晶说：这些房屋购买时可以通过担保公司担保办理贷款，但是必须一次性向拍卖主持机构(法院)付款。”林晶认为购买此类型房屋要注意以下3点：一是要在正规的拍卖主持机构拍得购买权;二是产权问题无须担心，但手续办理时间较长，要有打持久战的心理准备;三是要留意收楼时间及收楼方式，防止房屋本身存有租约。

买拍卖房最好先去看看

金信联行总经理罗凤也告诉记者，这些拍卖的房屋多为债权债务问题，所以要通过拍卖成功才能购买，无论是购买还是办房产证都跟正常手续一样，在费用上一般要多出5个点的拍卖费，而且不可以进行贷款购买，必须一次性付款。

罗凤解释说：购买拍卖得来的房屋，其实跟正常购买二手房基本一样，而且在费用上一般会低于市场价很多，很是诱人，但不能忽略被拍卖房屋本身有可能在位置、楼龄、户型、朝向、装修等方面存在瑕疵，建议买者还是要亲自去房屋实地看看，正确估量一下房屋的价值。”

二手房过户流程是怎样的?

读者苏小姐问：我刚刚购入一套南城区的二手房,我想咨询一下,跟业主在中介签订购房合同后,要多长时间才能拿到房产证?整个过户流程是怎样的?

回复：二手房交易办理程序是：1.一手业主办理《房地产权证》;2.评估公司对所交易的房屋进行评估;3.到房屋所在地房管所办理过户手续; 4.一手业主到房屋所在地地税交纳营业税、所得税，二手业主到房屋所在地财政局交纳契税，到房管所交纳办理《房地产权证》的费用;5.等待出证。 没土地证的房子能买吗?

读者李先生问：我看中了万江区中兴商住楼的一套二手房，但卖家只有房产证，没有土地使用证，请问能买吗?会不会有风险?

回复：目前东莞商品房个人都没有土地使用权证，可以进行买卖。

回复：此为物权权属争议，不动产物权以登记为准，登记与实际权利人不符的，除非有证据证明登记错误或实际权利人才是不动产的所有人。

没交楼也要交物管费吗?

读者谢先生问：我是2008年11月签的购房合同，上面注明是去年8月31日交楼，不过最近了解到，可能要到今年10月31日才能交楼。合同上有注明逾期交楼会按合同贴补几个月的物业管理费，可我们昨天去了解才知，原来我们的购房合同一旦生效,就产生了物业管理费用。请问还没收楼,我们也需要支付出物业管理费用吗?这个小区在去年3月也出了一张通告,要求所有业主交3000多元的物业维修费用,请问这笔费用我们是否也需要支付呢?
